Changes to Biodiversity Net Gain Requirements from July 2026

​The Government has announced a number of changes to the Biodiversity Net Gain regime that are expected to take effect from 31 July 2026, subject to the necessary legislation being brought into force. These changes are intended to simplify the BNG process for smaller developments and improve the operation of the system in practice.

One of the most significant changes is the removal of the current exemption for small self-build and custom-build developments. As a result, self-build and custom-build housing schemes that are currently exempt from mandatory BNG may be required to demonstrate compliance with Biodiversity Net Gain requirements from 31 July 2026.

At the same time, a new area-based exemption is expected to be introduced for certain developments on sites of 0.2 hectares or less. You should therefore  seek professional advice  to determine whether a proposed development will qualify for an exemption or be required to achieve the biodiversity gain objective.

As the detailed legislative changes and transitional arrangements continue to be implemented, applicants should ensure they are working from the latest Government guidance when preparing planning applications.
