Mark Doodes Planning were instructed to submit an application to remove a condition on a commenced development in Midgham, West Berkshire.
As part of an approval in 2015, the Local Planning Authority took the unanimous decision to remove all permitted development rights for the property, meaning that if our client had wished to erect a green house, shed, outbuilding, satellite dish, porch, paving or created new windows etc this would trigger the need for a planning application to be submitted to the Local Planning Authority. This would make a relatively inexpensive project in to a complicated and costly planning project where elevations, floorplans, as well as planning fees, would need to be considered. The LPA refused the application to reinstate the permitted development rights sighting, amongst other things, harm to the nearby AONB, local president and a view that the property was already close to being fully developed. MDP assembled a comprehensive appeal submission, including a robust Statement of Case which the Planning Inspectorate upheld in January 2023.; the property has its Permitted Development Rights reinstated. |
